Lawsuit Filed After Trucker Burned Alive in Wrecker Crash on Transmountain in El Paso

EL PASO, Texas — The son of a 65-year-old truck driver who was burned alive inside a heavy wrecker earlier this month has filed a lawsuit against Sheffield Towing Service, alleging gross negligence that led to his father's death.

The fatal crash occurred on May 8th at the intersection of Loop 375 and N. Desert Boulevard in northwest El Paso. According to reports from KFox14, Aldo Jenkins, 65, was riding in the passenger seat of a yellow 1994 Kenworth heavy wrecker that was towing his disabled semi truck. The 28-year-old driver of the wrecker allegedly failed to brake at the intersection, causing the rig to plow into 11 other vehicles before catching fire.

Jenkins was trapped inside the cab and burned to death, according to Kherkher Garcia LLP, the law firm representing his son. Seven other people were injured in the multi-vehicle crash.

The lawsuit, filed by Jenkins’ son, claims that the tow truck driver was speeding, distracted by an electronic device, and failed to maintain a safe following distance, all while consciously disregarding serious risks to others on the road.

The suit also targets Sheffield Towing Service, alleging that the company:

  • Failed to train and supervise its drivers properly

  • Did not implement safety policies to prevent driver distraction

  • Lacked protocols for safely operating a tow truck transporting another large vehicle

 

Kherkher Garcia LLP is seeking justice and compensation for Jenkins' death, citing a “negligent and careless disregard” for safety in the name of profit.

The case is expected to bring further scrutiny to towing industry standards, especially for operators hauling heavy-duty commercial trucks.
