Truck driver faces attempted murder charges following alleged attempt to set baby on fire at New York truck stop

Police say that a truck driver is facing multiple charges following a Tuesday incident at a truck stop in Seneca County, New York.

 

According to Seneca County Sheriff W. Timothy Luce, 28 year old Florida-based truck driver Jamie Avery Jr. has been charged with attempted aggravated murder, second-degree attempted murder, second-degree arson, second-degree attempted arson, and two counts of endangering the welfare of a child.

The charges stem from an incident that began early on May 3 at a Love’s truck stop in Tyre, New York.

 

During a Wednesday press conference, Sheriff Luce said that Avery set several fires at the Love’s location around 5:30 a.m., which prompted truck stop workers to call 911.

Luce said that officers determined that Avery and a second suspect poured flammable liquid on a one year old child and unsuccessfully attempted to set the child on fire inside the building.

After Avery and the other suspect were taken into police custody, a suspicious device was discovered in the men’s restroom at the truck stop. After the bomb squad responded, the device was later determined to be a replica and not an actual explosive device.

 

After arresting Avery and the other suspect, a four year old child was discovered inside the cab of Avery’s truck suffering from a head injury. Police broke into the truck to rescue the child.

Both children were hospitalized and are expected to recover.

Police believe that may be a parental relationship between the suspects and the children, but this remains under investigation.

 

No charges have been filed against the unnamed suspect at this time. However, police say that both Avery and the other suspect could face additional charges.
