2nd lawsuit brought against concrete truck driver in fatal bus crash

Six families involved in lawsuit brought against concrete truck driver following fatal school bus crash in Texas several weeks ago. 

 

The accident occurred in Bastrop County, Texas in March, and led to the deaths of 5-year-old Ulises Rodriguez Montoya and 33-year-old Ryan Wallace. 42-year-old Jerry Hernandez, the driver of the concrete truck, has been charged with negligent homicide, and admitted to consuming narcotics and getting little sleep in the hours before the crash.

One of the teachers on board the school bus during the crash has since sued Hernandez and his employer F.J.M. Concrete, and now six families are following suit with their own lawsuit, reported ABC 7.

 

The lawsuit filed by the six families states that the accident “forever altered the courses of all lives of those on the bus.”

A seventh family has also joined the lawsuit brought by the teacher, claiming personal injury sustained in the crash. 

“Our kid was another one of the students and they unfortunately witnessed and experienced things that us as parents try to protect our kids from ever having to witness,” said Laura Ramos James, the attorney for that seventh family. 

 

“There are so many people injured that the funds to compensate their medical expenses, their disfigurement, and things that the law allows for them to obtain are insufficient. So, sadly, there just may not be enough for everyone.”

James says that she has not “ruled out liability of other parties” in the case.
