Alert: If you use this ELD, the FMCSA says that you’re no longer compliant

On Friday, the Federal Motor Carrier Safety Administration (FMCSA) issued an alert informing users that an ELD device is no longer approved for use by truck drivers and motor carriers.

 

Effective June 24, 2022, the FMCSA says the ArionT ELD has been removed from the agency’s list of approved devices and added to the list of revoked devices “due to the company’s failure to meet the minimum requirements.”

All ArionT ELD users are required to take the following steps, according to the FMCSA:

 
  1. Discontinue using the revoked device(s) and revert to paper logs or logging software to record required hours of service data.
  2. Replace the revoked device(s) with compliant ELD(s) from the Registered Devices list before August 24, 2022.

Carriers have a 60 day grace period to replace the revoked device with a compliant device.

The FMCSA says that they will “encourage” safety officials not to cite drivers using ArionT ELD for 395.8(a)(1) – “No ELD” or 395.22(a) – “Failed to use a registered ELD.” Instead, the agency is asking safety officials to review the driver’s the driver’s paper logs, logging software, or use the ArionT ELD display as a back-up method to review the hours of service data.

As of August 24, 2022, motor carriers that continue to use the ArionT ELD will be considered to be operating without an ELD, and safety officials who encounter a driver using the device should place the driver out of service, the FMCSA states.
